Terms & Conditions

You must be at least 18 years old to create an account and purchase a membership. Members between 13 and 17 years of age may use the Services only with the in-person consent and supervision of a parent or legal guardian who accepts these Terms on their behalf and signs our liability waiver. By using the Services, you represent that the information you provide is accurate and that you are legally able to enter into this agreement.

Certain features — including class booking, check-in, membership management, and notifications — require an account accessible through our website and mobile app. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to keep it current. We may suspend or terminate accounts that contain false information or are used in violation of these Terms.

The mobile app may send push notifications related to your membership, class schedule, bookings, and studio announcements. You can disable push notifications at any time in your device settings.

Memberships are billed on a recurring basis (e.g., monthly) through our third-party payment processor, Stripe. By purchasing a membership, you authorize us and Stripe to automatically charge your payment method on each renewal date until you cancel. Membership fees, class limits, and benefits are described at the point of purchase and may change as described in Section 12.

• Auto-renewal. Your membership renews automatically for successive billing periods unless cancelled before the next renewal date.
• No refunds. Except where required by law, all payments are non-refundable, including for unused classes, partial billing periods, or periods of non-attendance.
• Failed payments. If a charge fails, we may retry the charge, suspend access to classes, and/or cancel the membership until payment is resolved.
• Price changes. We may change membership prices on a prospective basis with reasonable notice; continued use after a price change constitutes acceptance.

You may cancel your membership at any time through your account or by contacting us. Cancellation stops future renewals; it does not refund amounts already charged, and you may retain access through the end of your current paid billing period. You remain responsible for any charges incurred before cancellation takes effect.

Class spots are limited and offered on a first-come, first-served basis subject to your membership's weekly limits. You are responsible for booking, cancelling, and arriving on time. We may apply booking windows, cancellation deadlines, and no-show or late-cancellation fees in accordance with the policies posted in the app or studio at the time. We may also cancel, reschedule, or substitute instructors for any class.

We reserve the right, in our sole discretion and to the fullest extent permitted by law, to suspend, restrict, or terminate your membership, account, or access to any part of the Services at any time, with or without notice and with or without cause. This includes, without limitation, conduct we consider unsafe, abusive, harassing, dishonest, disruptive, or in violation of these Terms, our studio rules, or applicable law. Where a termination is for our convenience and not for cause, we may, at our discretion, refund any prepaid, unused membership fees on a pro-rated basis; no refund is owed for terminations resulting from your conduct or breach.

We may also refuse service to anyone for any lawful reason. Termination does not relieve you of obligations incurred before termination.

You agree to follow all posted studio rules, instructor directions, and safety guidelines, to use equipment properly, to wear appropriate attire, and to treat staff and other members with respect. You agree not to attend while under the influence of drugs or alcohol, while experiencing symptoms of a contagious illness, or in any condition that may endanger yourself or others.

You understand that strength training, high-intensity exercise, and related physical activity involve inherent risks, including the risk of serious bodily injury, disability, or death. You voluntarily and knowingly assume all such risks, whether foreseen or unforeseen, arising out of your participation in any activity at or through GI Fit Studio. Your participation is voluntary and at your own risk.

To the fullest extent permitted by law, you release, waive, and discharge GI Fit Studio and its owners, officers, employees, trainers, contractors, and agents (the "Released Parties") from any and all claims, demands, or causes of action arising out of or related to your use of the Services or any injury, loss, or damage you may suffer, except to the extent caused by the Released Parties' gross negligence or willful misconduct where such a release is not permitted by law.

You agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party. A separate written waiver and release of liability is required at sign-up and is incorporated into these Terms by reference.

The Services, including any content in the app or provided by trainers, are for general fitness purposes only and are not medical advice, diagnosis, or treatment. Consult a physician before beginning any exercise program, especially if you have a medical condition, injury, or are pregnant. You are responsible for exercising within your own limits and stopping if you feel unwell. We are not responsible for any health consequences resulting from your participation.

To the maximum extent permitted by law, in no event shall the Released Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or related to the Services, whether based in contract, tort, or any other legal theory, even if advised of the possibility of such damages. To the maximum extent permitted by law, the Released Parties' total aggregate liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to GI Fit Studio in the three (3) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

We may modify, suspend, or discontinue any part of the Services (including class schedules, app features, or membership tiers) at any time. We may also update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date and, where appropriate, by additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

The Services, including the website, mobile app, logos, branding, text, graphics, and programming content, are owned by or licensed to GI Fit Studio and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration in or near Los Angeles County, California, except that either party may bring qualifying claims in small-claims court. To the fullest extent permitted by law, you and GI Fit Studio waive the right to a jury trial and the right to participate in a class, collective, or representative action. If any provision of this section is held unenforceable, the remainder of these Terms shall remain in effect.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms constitute the entire agreement between you and GI Fit Studio regarding the Services and supersede any prior agreements.
